This Employer Agreement governs the terms upon which you access and use the Hoodex Platform to discover, connect with, and engage Workers. By completing Employer registration, you accept this Agreement.
1. Employer Status & Responsibility
- Hoodex is a technology intermediary that facilitates connections between Employers and independent Workers. Hoodex is NOT a manpower agency, staffing company, placement firm, or labour contractor.
- Workers are independent service providers and NOT employees of Hoodex.
- You are solely responsible for determining whether to engage a Worker and for all terms of that engagement.
- Where any law or authority determines that your engagement of a Worker constitutes employment, you shall be solely responsible for all employer obligations under applicable labour laws.
2. Employer Obligations
- Post only accurate, lawful, and genuine job listings.
- Provide a safe, legal, and dignified working environment for all Workers.
- Pay Workers the agreed compensation promptly and fully upon job completion.
- Comply with all applicable labour laws, including applicable minimum wage laws.
- Obtain all legally required permits, licences, and approvals for the work.
- Not discriminate against Workers on prohibited grounds.
- Not harass, abuse, or exploit Workers in any form.
- Report Worker misconduct or safety incidents to Hoodex immediately.
- Not attempt to solicit Workers for off-platform employment during Platform use and for 12 months after deactivation.
3. Workplace Safety Responsibility
The Employer is solely and entirely responsible for maintaining a safe workplace. Hoodex has NO visibility over, control over, or responsibility for the physical safety of the Employer's premises.
- Ensure premises are safe and free from hazards before a Worker arrives.
- Provide necessary safety equipment and instructions for the job.
- Not require Workers to perform tasks without proper safety measures.
- Immediately report and respond to any safety emergency.
4. Prohibited Employer Conduct
- Posting fake, misleading, or illegal job listings.
- Requesting Workers to perform illegal, hazardous, degrading, or unethical activities.
- Requiring Workers to handle large cash amounts without adequate security measures.
- Pressuring Workers to accept payment outside the Platform system.
- Recording, surveilling, or photographing Workers without consent.
- Using Worker personal data obtained through the Platform for any unauthorized purpose.
- Retaliatory negative reviews or rating manipulation.
- Any form of sexual harassment or physical abuse toward Workers.
5. Payment & Fees
- You agree to pay the Platform fee and service charge as displayed at job posting.
- All payments must be processed through the Platform. Off-platform payments are prohibited and unprotected by Hoodex.
- Withholding payment to a Worker without cause is a serious violation of this Agreement.
- Refunds and cancellations are governed by the Cancellation & Refund Policy.
6. Labour Law Compliance Indemnification
You shall indemnify and hold harmless Hoodex from all claims, losses, damages, penalties, and legal costs arising from: (a) breach of applicable labour laws; (b) Worker injury, accident, or death at your premises; (c) illegal job postings; (d) non-payment to Workers; (e) misrepresentation; (f) any employment classification dispute arising from your engagement of Workers.
7. Acknowledgement
By using the Hoodex Platform as an Employer, you confirm that you have read, understood, and accepted this Agreement and all Platform policies.
