Worker Classification Disclaimer

This document is part of Hoodex's official policies for workers, employers, and platform users.

Critical legal notice

All Workers and Employers must read this Disclaimer before using the Platform. This document is fundamental to the legal framework of all Platform interactions.

1. Nature of Worker Relationship

Workers on the Hoodex Platform are independent service providers (gig workers) and NOT employees of Hoodex. This classification is supported by the following characteristics:

  • Workers have complete autonomy to log in or not, and to accept or decline any job offer.
  • Workers may simultaneously work for other platforms, clients, or employers.
  • Hoodex does not set specific working hours for Workers.
  • Hoodex does not provide tools, equipment, or workspace to Workers.
  • Workers are paid per completed job, not a regular salary.
  • Workers are responsible for their own expenses, transport, and tools.
  • Hoodex does not direct the manner in which Workers perform services.

2. Gig Worker Framework (India)

  • The Code on Social Security, 2020 recognizes "gig workers" as a distinct category, separate from traditional employees.
  • Hoodex acknowledges obligations under applicable gig worker legislation, including state-level Acts where notified.
  • Workers are encouraged to register on the e-Shram portal (eshram.gov.in) for government welfare benefits.
  • Hoodex will comply with NDUW registration requirements and welfare fund contributions as required by law.

3. No Employment Benefits from Hoodex

Workers expressly acknowledge they are NOT entitled to receive from Hoodex:

  • Provident Fund (EPF) contributions.
  • Employee State Insurance (ESIC) benefits.
  • Gratuity payments.
  • Paid, sick, or maternity leave.
  • Minimum wage guarantee from Hoodex.
  • Bonus, overtime, or any statutory employment benefit.

4. Employer Classification Responsibility

Employers who engage Workers through the Platform are solely responsible for determining the legal classification of Workers under applicable labour laws in the context of their specific engagement. Where an Employer provides extensive direction, control, or integration of a Worker into their organization, such Employer may independently incur employer obligations under applicable law. Hoodex assumes no liability for such classification.

5. Evolving Legislation

Worker classification laws in India are evolving. Hoodex will update its policies and practices to comply with laws as they are enacted and notified. Workers and Employers are advised to stay informed.
