THIS AGREEMENT DOES NOT CREATE AN EMPLOYMENT RELATIONSHIP. YOU ARE AN INDEPENDENT SERVICE PROVIDER AND NOT AN EMPLOYEE, AGENT, OR CONTRACTOR OF HOODEX. READ THIS AGREEMENT IN FULL BEFORE REGISTERING AS A WORKER.
1. Preamble
This Worker Agreement governs the terms upon which you register and operate as a Worker on the Hoodex Platform. It is a binding legal contract between you and Skyhood (Hoodex). By completing Worker registration, you accept this Agreement in its entirety.
2. Worker Classification — Independent Service Provider
- You are registering as an independent service provider (gig worker), not an employee of Hoodex.
- Hoodex does not control, direct, supervise, or manage the manner in which you perform services.
- You have complete freedom to accept or decline job offers, set your own availability, and work for multiple platforms simultaneously.
- No employment relationship, principal-agent relationship, or labour-contractor relationship exists between you and Hoodex.
- You are NOT entitled to employment benefits from Hoodex, including PF, ESIC, gratuity, paid leave, bonus, or any statutory employment benefit.
3. Gig Worker Legal Framework (India)
- Hoodex recognizes the Code on Social Security, 2020, which recognizes gig workers as a distinct category.
- Workers are encouraged to register on the e-Shram portal and avail government social security schemes for unorganized workers.
- To the extent required by applicable state-level gig worker legislation (e.g., Rajasthan Platform-Based Gig Workers Act, 2023 or similar), Hoodex shall comply with applicable obligations.
- Hoodex will update this Agreement to comply with evolving gig worker legislation.
4. Worker Obligations
- Complete full KYC and verification before accepting any job.
- Possess and maintain all licences, certifications, and permits legally required for offered services.
- Arrive at job locations on time or provide timely advance notice of delay or cancellation.
- Perform all services with reasonable care, skill, and diligence.
- Comply with all workplace safety rules at the Employer's premises.
- Maintain professional conduct, personal hygiene, and respectful communication at all times.
- Not consume alcohol, intoxicants, or controlled substances during or before a job.
- Handle all Employer property and equipment with due care and report any damage immediately.
- Not solicit Employers for direct, off-platform engagements.
- Report all incidents, accidents, injuries, misconduct, or safety concerns to Hoodex immediately.
5. Earnings, Payments & Taxes
- You receive earnings (job fee minus Platform Commission) credited to your Platform Wallet after job completion.
- You are solely responsible for all income tax, GST (if applicable), professional tax, and other tax obligations on earnings.
- Hoodex may deduct TDS as required under Section 194O or other provisions of the Income Tax Act.
- Hoodex will issue TDS certificates (Form 16A) within prescribed timelines.
6. Safety & Health
- You perform services at your own risk. Hoodex does not provide workers' compensation, accident insurance, or health coverage.
- You are strongly encouraged to obtain personal accident insurance.
- You must not accept jobs at locations or in conditions that pose an unreasonable safety risk.
- You may terminate a job immediately if you face an unsafe, abusive, or threatening situation, and must report it to Hoodex.
- Use the in-app SOS / Emergency button in emergencies.
7. Non-Solicitation
During Platform use and for 12 months after account deactivation, you agree not to directly solicit, engage, or contract with any Employer found through the Platform for the purpose of bypassing the Platform, except where such a relationship pre-existed your Platform registration.
8. Confidentiality
All data shared with you through the Platform (Employer details, job details, location) is confidential and must be used only for the purpose of performing the relevant job. You may not store, share, sell, or misuse data obtained through the Platform.
9. Indemnification by Worker
You shall indemnify and hold harmless Hoodex from all claims, damages, losses, penalties, and legal costs arising from: (a) your negligence or misconduct during a job; (b) breach of this Agreement; (c) violation of any law; (d) injury or damage caused by you to Employers or third parties; (e) tax non-compliance; (f) misrepresentation of qualifications or identity.
10. Acknowledgement
By completing Worker registration on Hoodex, you confirm that you have read, understood, and voluntarily agreed to this Worker Agreement, the Terms & Conditions, Privacy Policy, and all other Platform policies, and that you are entering into this Agreement as an independent service provider.
