Limitation of Liability

1. Aggregate Liability Cap

Hoodex's maximum aggregate liability to any single User for any and all claims shall not exceed the lower of:

• Platform Commission paid by that User in the 3 months preceding the claim; OR
• INR 5,000 (Five Thousand Rupees).

2. Exclusion of Consequential Damages

Hoodex is NOT liable under any circumstances for:

• Loss of income, loss of profits, or loss of opportunity.
• Loss of data, loss of goodwill, or reputational harm.
• Indirect, incidental, punitive, or consequential damages of any nature.

3. Specific Exclusions

• Worker injury, illness, or death during a job engagement.
• Employer non-payment or contract breach.
• Third-party service provider failures (payment gateways, KYC providers, cloud).
• Network outages, Platform downtime, or technical errors.
• Loss from unauthorized Account access due to User security failures.
• Harm caused by another User's acts, omissions, or fraud.
• Government regulatory penalties imposed on Users.
• Worker no-shows, poor performance, or late arrivals.
• Unsafe workplace conditions created by an Employer.

4. Mandatory Law Exception

Nothing in this policy limits liability in a manner prohibited by mandatory provisions of applicable Indian law. Liability for death or personal injury caused by Hoodex's gross negligence or wilful misconduct is not excluded.

5. Governing Law

This policy is governed by Indian law. Disputes regarding liability are subject to mandatory arbitration under the Terms & Conditions.
